Divorce Mediation in Mobile, AL

mycasewebsites2 • Jun 29, 2015

When I was defending physicians, hospitals, and nurses in South Georgia with Hall, Booth, Smith, P.C., many years ago, I had the pleasure to work under the tutelage of one Anthony Rowell, Esq.  We called him “Ol’ Tone.” Ole Tone had battled for the insurance companies for what seemed like a millenia and he reminded me of the late Georgia author/columnist, Lewis Grizzard.

Among Ole Tone’s many famous pearls of wisdom that I remember almost daily in my practice helping families in Mobile, AL, is that, “Ron, the principal of the matter is worth about $2,500.00.” With the passing of time and inflation, the reality of the matter is that the principal of the matter in family law cases these days appears to be up to around $4,000.00. So, you are asking yourself, “What’s the point?”

The point is that a good portion of the divorce and custody cases I see involve “the principal of the matter.” Someone’s feelings are hurt. Someone cheated. Someone made bad financial decisions for the family. No one is a danger of harm. There are no assets above $250,000.00 to fight over. There’s going to be a divorce. The children are going to live full time with one parent and have visitation with the other, who will pay child support according to the guidelines. Why would you spend $10,000.00 (plus) to get to where you know you’re already going?

You don’t have to fight it out. I offer mediated and collaborative divorce options that will result in a final order of divorce that meets your individual needs, not one imposed upon you by the Court. The process will take a few months as opposed to year(s). Your children may be less likely to need therapy and you may walk away with the tools you need to let go of your anger toward your former spouse.

The costs of mediation and/or collaboration are dramatically less than fighting it out and the risks are lower. You control the process. If we can’t work it out, nothing that goes on can be used against you and I can’t represent either of you in a contested divorce. If you are interested in the finer points of the difference between mediation and collaboration, here’s a good read:

Call me at: (251)445-0891, or email me at: ron@mcbaylaw.com. The initial consultation is free of charge and you’ll walk away with a flat fee, guaranteed cost quote. Save your money for your kids; they’re much more valuable than “the principal of the matter.” Tell ’em Ole Tone sent you!

Mobile, Alabama has its fair share of military service members, veterans, and retirees. Sometimes, those folks get divorced. When they do, the military spouse’s military retirement is subject to equitable division by the Court. Either the parties agree on the division of military retirement or the Court divides it. In any event, the non-military spouse […] The post Love is a Battlefield-VA Disability Payments in Divorce appeared first on The Law Offices of Teague and McBay.

Thankfully, I’ve recently had a spate of couples who have decided to try and make their marriages work after filing a divorce. In a couple of instances, even after a great deal of fighting and legal wrangling, I’ve had clients lay down their swords and engage in reconciliation. I love it when that happens. In […] The post Making Up Is Hard to Do appeared first on The Law Offices of Teague and McBay.

I grew up watching Sesame Street. I loved Oscar and the Cookie Monster. One of my favorite regular skits was the “One of These Things is Not Like the Other.” I loved picking out the thing that was different. Of course, there were only ever four “things,” so choosing what was different was relatively easy. More than 30 years ago, the Georgia Satellites released a song about a marriage ultimatum: “Keep Your Hands to Yourself.” The lyrics document the struggle between the singer and his lover over the terms of their relationship. We don’t know how that story ends; whether the couple married or split up. The song came to […] The post Free Milk and a Cow: Common Law Marriage appeared first on The Law Offices of Teague and McBay.

If you have children, you’ve probably seen The Incredibles. I’ve seen it a MILLION times. One of my favorite scenes is the one in which Syndrome, who has Mr. Incredible in a seemingly inescapable situation, realizes that he is monologuing. Of course, monologuing is a common theme in all sorts of hero/villain movies. The hero is […] The post Testimony in Divorce Cases: Don’t Monologue appeared first on The Law Offices of Teague and McBay.

As a child of the seventies and eighties, I have vivid memories of hearing “Paradise by the Dashboard Light” as performed by Meatloaf on the radio. Of course, early on, I had no frame of reference for the story told in song about the heat of passion and the consequences. For those of you who’ve […] The post Waiting for the End of Time: Divorce in Mobile, Alabama appeared first on The Law Offices of Teague and McBay.

If you are paying or receiving alimony as part of a Divorce Order in Alabama, this one is for you. Under Alabama Law, the obligation to pay periodic alimony terminates upon the receiving party’s “cohabitation” with a member of the opposite sex. So, what does that mean? Under the case law, cohabitation is that thing […] The post The Effects of Cohabitation on Alimony in Alabama appeared first on The Law Offices of Teague and McBay.
